Carevive Systems (“Carevive,” “we” or “us”) owns and operates the website www.carevive.com (“the Site”). Carevive Systems also develops, operates and distributes certain software applications (Apps), which include hosted applications and applications for mobile devices and related service software (the “Service Software”). Carevive’s automated software enables each patient to receive his or her own unique, personalized care plans that can be customized and edited by oncology physicians and nurses at each clinic visit, in a way that is not possible with either electronic medical records or care management software. To develop our care plans, our software generates automated, personalized symptom assessment and management guidance based on individual patient diagnosis, treatment, and risk . The Site, Apps and Service Software along with the communication tools, data collection and transmission, storage, analysis and reporting tools, functions and related services, are collectively referred to in this Privacy Policy as the “Service.”
Carevive understands how important the privacy of personal information is to our users. This Privacy Policy covers how Carevive and/or the Service collects, uses, retains and discloses Personally Identifiable Information (“PII”) and Protected Health Information (PHI) through the Site, App and Service. PII includes information about you or the Care Recipient that is personally identifying such as but not limited to your name, email address, date of birth and phone number and which is not otherwise publicly available. PHI includes information relating to your health, for example, but not limited to medical history, test and laboratory results, insurance information and other data that a healthcare professional collects to identify an individual and determine appropriate care. PII and PHI may include other types of information depending on the legal definition that applies in your physical location. In some locations, health information is referred to as “sensitive data.” Only the definitions of PII, PHI, sensitive data or personal data that apply in your local jurisdiction will apply to you under this Privacy Policy. This Privacy Policy is not intended to, and should not be interpreted as, providing any greater privacy rights than the law that applies to you based on your physical location and residency. PII and PHI are referred to collectively in this Privacy Policy as “PII.”
Agreement
By using this Site or by providing PII to Carevive, you accept and hereby consent to our collection, use, retention, and disclosure of your PII in accordance with the terms of this Privacy Policy. If you provide your email address, you consent to receive promotional emails from us. If you provide a mobile phone number, you consent to receive promotional text messages from us. You may opt out as described below. If you choose not to provide the requested information you will not be able to access certain features on the Site.
This Privacy Policy may change from time to time, so please check back periodically to check the most recent modification date to ensure that you are aware of any changes in our processing of your PII. Your continued use of the Site after any changes signifies your express consent to any such changes. If you do not agree to such changes, you must immediately stop using the Site. This Privacy Policy was last modified on March 25, 2019.
Information Collection and Use; Choice and Consent
You may browse the Site without providing any PII, although your IP address will be collected. If you contact us for information through Contact Us, we collect name and email so we can respond to you. If you request a meeting or a demo through the Site, we collect your first and last name, email address, phone number, job title, employer/cancer center affiliation, and information on your medical practice/health system so we can respond to your request. If you wish to access webinar slides, we collect your first and last name, employer and email address in order to grant you access.
In sum, Carevive uses your PII to:
- Communicate with you;
- De-identify your PHI and PII to create and share de-identified analytical information;
- Reply to your request for information or comments;
- Monitor your usage of the Site;
- Send you promotional information about Carevive.
When we collect your email address or phone number, your information will be added to our promotional mailing list and we will send you our email newsletter and other promotional information and updates about Carevive by email and/or text message. You may unsubscribe from any of our emails by clicking “unsubscribe” at the bottom of the email you receive from us and you may unsubscribe by texting “STOP” to our text messages. You may also unclick the box on our “request a demo” page when you request a demo or any other opt-in form, if you do not want to receive our email newsletter.
Cookies And Other Technologies
The Site uses a software technology called “cookies.” Cookies are small text files that we place in visitors’ computer browsers to store their preferences. Whenever you use the Site, Carevive also receives and records information on our server logs from your browser, including your IP address, Carevive’s cookie information, and the pages you request, and may relate it to the PII you provide.
“Web beacons” are small pieces of code placed on a web page to monitor the behavior and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page. We may use web beacons on the Site from time to time for this purpose.
Users who disable their web browsers’ ability to accept cookies will be able to browse the Site, but will not be able to access or take advantage of all of the features and services on the Site. Analytics
We also maintain standard web logs for analytics purposes that record data about all visitors who use this Site. When you use our Site, we may employ pixel tags (also known as clear gifs or web beacons) and cookies, which are used to track the online usage patterns of our users anonymously. No personally identifiable information from your account is collected using these pixel tags. In addition, we may also use pixel tags in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make Carevive better for our users.

- The domains from which you accessed the Site
- The type of browser and operating system you use
- Your Internet Protocol (IP) address
- The date and time you visited the Site
- The pages you viewed on this Site
- The address of the website you linked to the Site from
We use the web log information to help us design our Site, to identify popular features, and to make the Site more useful for our visitors. Weblogs are recorded in sequential files, and we do not try to identify individuals from weblogs or use weblogs to gather information about individuals. However, we may use web logs to identify any person attempting to break into or damage the Site, and we may share web log information with law enforcement agencies if we believe that we have evidence of a violation of computer security or related laws.
Protection of Your Information
We will take appropriate technical and organizational safeguards to protect PII from theft, other loss, misuse, and any unauthorized access, copying, collection, use, disclosure, alteration or destruction. We follow generally accepted standards to protect the PII submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
We will retain PII for as long as necessary to provide our services. We will retain and use PII as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Information Sharing and Disclosure
We disclose your PII and non-PII to third party vendors who help us operate the Site, such as our customer relationship management (CRM) vendor. These third parties are contractually obligated to maintain the confidentiality of your PII consistent with the terms of this Policy and to comply with the applicable data protection laws.
We will disclose your information in response to valid legal process, for example, in response to a court order, a subpoena or other legal request for information, and/or to comply with applicable legal and regulatory reporting requirements. In addition, we may transfer your information to an entity or individual that acquires, buys, or merges with Carevive, or our other business units.
International Transfer of Your PII and Your Express Agreement
The Site is geared towards U.S. residents and is operated in the United States. If you operate the Site or provide PII from a location outside the U.S., your PII will be transferred to the U.S. and processed and disclosed in accordance with the terms of this Privacy Policy. By accessing the Site or providing PII, you acknowledge and expressly consent to our processing and disclosure of your PII in this way. The U.S. has not been recognized as providing an adequate level of protection according to European Union (EU) data protection requirements, but we will take all steps reasonably necessary to ensure that users’ PII is treated as described in this Privacy Policy. By accessing the Site or providing PII to access the certain features on the Site, you expressly agree to such transfer, processing, storage and disclosure in the United States.
Social Media Features
Our Site includes features from third party social media websites such as Facebook, Twitter, Pinterest, Google+ and LinkedIn that run on our Site. Please note that our Site is not sponsored or endorsed by any of these, which are trademarked and owned by third parties and not by us. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Site. This Privacy Policy does not apply to these features. Your interactions with these features would be governed by the privacy policy and other policies of the companies providing them.
Links to Other Sites; Transactions with Third Parties
The Site may contain links to other sites that are not owned or controlled by Carevive. Please be aware that we are not responsible for the privacy practices of these other sites. We encourage you to review the privacy policies and statements of other sites to understand their information practices. Our Privacy Policy applies only to information collected by our Site and Services.
Carevive is not responsible for and will not be a party to any transactions between you and a third party provider of products, information or services. Carevive does not monitor such transactions or ensure the confidentiality of your PII, including credit card information, for any third party transaction. Any separate charges or obligations you incur in your dealings with these third parties linked to Carevive’s Site are solely your responsibility.
Children’s Privacy
Our Site is directed to individuals who are age 13 or older. We do not knowingly collect information from children. If you believe your child has provided information to the Site please contact us using the information provided below.
Your California Privacy Rights; California Do Not Track Disclosures
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by Carevive or its subsidiaries to a third party for the third party’s direct marketing purposes. If you wish to receive this information, please contact us in writing at the address below. Please know that we do not make such disclosures. We also do not follow “Do Not Track” signals.
